California’s seven-day prenup rule
Fast drafting still needs a realistic review and signing schedule.
For agreements signed on or after January 1, 2020, California requires at least seven calendar days between presentation of the final agreement and signing, whether or not the affected party has counsel. The statute provides an exception for nonsubstantive amendments that do not change the terms. See Family Code § 1615(c)(2)(B).
Start before the final review period.
Leave time to gather financial information, obtain legal advice and discuss changes. Seven days is a signing interval, not a promised turnaround from your first call.
What if the draft changes?
Ask your attorney whether proposed changes affect the signing date. Keep versions and delivery records organized. The statute also addresses advance advice to seek independent counsel. See Family Code § 1615(c)(1)–(2).
