California Prenup 7-Day Rule & Signing Timeline

For agreements signed on or after January 1, 2020, California requires at least seven calendar days between presentation of the final agreement and signing, whether or not the affected party has counsel. The statute provides an exception for nonsubstantive amendments that do not change the terms. See Family Code § 1615(c)(2)(B).

Start before the final review period.

Leave time to gather financial information, obtain legal advice and discuss changes. Seven days is a signing interval, not a promised turnaround from your first call.

A practical timeline for your agreement

Before drafting: explain your wedding date and goals, gather your financial records and arrange legal advice.
During drafting: discuss proposed terms and identify changes while there is still time to consider them.
When the final agreement is delivered: keep the version and delivery record. Your attorney can identify the applicable review interval and proposed signing date.
Before signing: confirm with counsel that timing, disclosure and any required explanations or waivers have been addressed. Sign before marriage and retain the completed documents.

Is this a rule about signing seven days before the wedding?

The statutory interval concerns presentation of the final agreement and signing. It is not simply a rule to sign seven days before the wedding. Drafting, advice, review and signing must still fit before marriage. Confirm your actual schedule with your attorney.

Can hiring a lawyer waive the waiting period?

No. The rule for agreements executed on or after January 1, 2020 applies regardless of whether the affected party has counsel. Read the separate independent counsel requirements as well.

What if the draft changes?

Ask your attorney whether proposed changes affect the signing date. Keep versions and delivery records organized. The statute also addresses advance advice to seek independent counsel. See Family Code § 1615(c)(1)–(2).
