Your prenup financial checklist

Gather the facts. Add your requests. Your attorney handles the drafting.

What to organize

  • Accounts: bank, investment and retirement statements.
  • Property: addresses, ownership, values and mortgage balances.
  • Businesses: ownership interests and available financial records.
  • Debts: loans, credit cards, guarantees and other obligations.
  • Income: pay records, tax returns and other income information.
  • Other assets: valuable belongings, digital assets and relevant trust or inheritance information.

Make your information clear.

Record the owner, value or balance, and date. Label estimates and missing information. Your attorney will tell you which supporting documents are needed.

Financial disclosure is part of California’s enforceability framework. Disclosure, written waiver, knowledge and unconscionability are addressed together in Family Code § 1615(a)(2).

Add your requests.

Write down what you want the agreement to address, such as a future home purchase, a business or responsibility for a debt. Plain language is fine.
